Succession

We understand that losing a loved one can be a difficult and emotional time. In some circumstances, a tenancy may be passed on to another family member or household member through a process called succession. 

Succession is the legal process that allows someone to take over a tenancy when the tenant has passed away. 

Whether a tenancy can be succeeded depends on: 

  • The type of tenancy  
  • Your relationship to the tenant  
  • Whether you lived at the property as your main home  
  • Whether a succession has happened before  

Who can apply for succession? 

In most cases, succession rights may apply to:

  • A husband, wife or civil partner  
  • A partner living with the tenant as a couple  
  • Another family member who has lived at the property for a qualifying period

Each case is assessed individually and supporting evidence may be required.

Once we receive your application, we will: 

  • Review the tenancy details  
  • Assess whether succession rights apply  
  • Contact you if we need further information  
  • Let you know the outcome in writing
