Succession
We understand that losing a loved one can be a difficult and emotional time. In some circumstances, a tenancy may be passed on to another family member or household member through a process called succession.
Succession is the legal process that allows someone to take over a tenancy when the tenant has passed away.
Whether a tenancy can be succeeded depends on:
- The type of tenancy
- Your relationship to the tenant
- Whether you lived at the property as your main home
- Whether a succession has happened before
Who can apply for succession?
In most cases, succession rights may apply to:
- A husband, wife or civil partner
- A partner living with the tenant as a couple
- Another family member who has lived at the property for a qualifying period
Each case is assessed individually and supporting evidence may be required.

What happens next?
Once we receive your application, we will:
- Review the tenancy details
- Assess whether succession rights apply
- Contact you if we need further information
